These Terms of Use set out the conditions for using the iOS app “タカノメ” (English name: “Hawk Maze”, the “App”) provided by Sato Daichi (the “Operator”). By using the App, you agree to these terms.
この利用規約は、Sato Daichi（以下「運営者」）が提供するiOSアプリ「タカノメ」（英語名：Hawk Maze、以下「本アプリ」）の利用条件を定めるものです。本アプリを利用した時点で、この規約に同意したものとみなします。
1. 本アプリについて
The App is a game where you memorize a route on a map seen from above, then walk through a 3D maze to the goal from memory. You may use it for personal, non-commercial enjoyment. Apple’s Licensed Application End User License Agreement (EULA) also applies.
本アプリは、上から見た地図でルートを覚え、3Dの迷路の中を記憶だけでゴールまで進むゲームです。個人で楽しむ目的に限り利用できます。Apple の「ライセンス済みアプリケーションのエンドユーザ使用許諾契約（EULA）」もあわせて適用されます。
2. スタミナ
Playing uses stamina: 5 for a challenge and 1 for practice. Stamina recovers by 1 every 2 minutes, up to 30. Stamina bought in the App can go over 30, but natural recovery stops while you are at or above 30.
遊ぶとスタミナを使います（チャレンジ5、練習1）。スタミナは2分ごとに1回復し、上限は30です。購入したスタミナは30を超えて持てますが、30以上の間は自然回復しません。
3. 有料アイテム
Stamina (consumable)
Purchased stamina is used up when you play. It is stored only on your device, so it cannot be restored if you delete the App or change devices. Except as required by law or Apple’s rules, it cannot be refunded or exchanged after purchase.
購入したスタミナは遊ぶと消費されます。端末の中だけに保存されるため、アプリの削除や機種変更をすると復元できません。法令または Apple の定めによる場合を除き、購入後の払い戻しや交換はできません。
PRO (one-time purchase)
With PRO, you can play without using stamina. PRO is linked to your Apple Account and can be restored with “Restore purchases” on the shop screen. While you have PRO, stamina cannot be purchased.
PROを購入すると、スタミナを使わずに遊べます。PROは Apple アカウントにひも付き、ショップ画面の「購入を復元」で復元できます。PROを持っている間は、スタミナは購入できません。
Payments and refund requests are handled by Apple.
支払いと返金の申し出は Apple が取り扱います。
4. ランキング
Rankings use Apple’s Game Center. Weekly rankings reset every Monday at 0:00 (Japan time). If you close the App during a challenge, the challenge ends and your result up to that point is recorded. The Operator may remove records that appear to have been obtained improperly.
ランキングには Apple の Game Center を使います。週間ランキングは毎週月曜0:00（日本時間）にリセットされます。チャレンジ中にアプリを終了すると、その時点でチャレンジは終了し、そこまでの記録が残ります。不正に得たと思われる記録は、運営者が削除することがあります。
5. 禁止事項
You must not:
- Modify, analyze or tamper with the App
- Send scores by improper means
- Interfere with the rankings or other players
- Break any law
本アプリの改造・解析・改ざん、不正な手段によるスコアの送信、ランキングや他の利用者への妨害、法令に反する行為を禁止します。
6. 変更・提供の終了
The Operator may change, suspend or end all or part of the App. If the App ends, unused paid items may become unusable, except as required by law.
運営者は、本アプリの全部または一部を変更・停止・終了することがあります。終了した場合、法令で定める場合を除き、未使用の有料アイテムは使えなくなることがあります。
7. 免責
The App is provided “as is”. The Operator does not guarantee that the App will always work or that data will never be lost. Except in cases of intent or gross negligence, and to the extent permitted by law, the Operator is not liable for damages arising from use of the App.
本アプリは現状のまま提供されます。運営者は、本アプリが常に動作すること、データが失われないことを保証しません。運営者の故意または重大な過失による場合を除き、法令で認められる範囲で、本アプリの利用により生じた損害について運営者は責任を負いません。
8. 規約の変更
The Operator may change these terms. The latest version will be posted on this page.
運営者は、この規約を変更することがあります。最新の内容はこのページに掲載します。
9. 準拠法・管轄
These terms are governed by the laws of Japan. Any disputes will be handled exclusively, in the first instance, by the court with jurisdiction over the Operator’s location.
この規約は日本法に従います。紛争が生じた場合は、運営者の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。
